Man is given seven months jail sentence after 2am trouble flared at McDonald’s in Ballymena

A man who was disorderly and assaulted three police officers after trouble flared at 2am at McDonald’s restaurant in Ballymena has been sentenced to seven months in custody but was released on £500 bail pending appeal.

Andrew Bain (20), of Montague Avenue, Ballymena, also resisted one of the officers in the execution of their duty on August 4 this year.

The defendant appeared at Ballymena Magistrates Court on Thursday.

A prosecutor said a group was acting in an anti-social manner in McDonald’s and they were told not to return.

Police were called and Bain attempted to enter the premises and became hostile and aggressive and was shouting and swearing before he threw a punch at an officer who was hit on the hand.

Bain was arrested and taken to the ground and he kicked out and attempted to headbutt an officer before being placed in limb restraints.

He then flung himself to the left trapping an officer’s arm on a door.

Defence barrister Stephen Law said the defendant had a “catalogue of psychiatric difficulties” and has now been “completely abstinent from drugs”.

Mr Law said Bain had not been in McDonald’s earlier and had just met the other group who were put out of the premises but police believed he had been part of the original group.

Handing down the jail sentence, District Judge Nigel Broderick said the defendant was in breach of two suspended sentences and had been given a chance to avoid going to prison but had then assaulted officers “who were doing nothing more than their job”.
