POLICE spotted a driver in a Maserati vehicle holding a mobile phone in his hand but the motorist claimed he had not been using it but rather was inspecting damage caused to the device when he had dropped it earlier onto concrete.
Prosecutors then offered no evidence regarding a charge of using a mobile phone whilst driving which was withdrawn but Eamon McAuley pleaded guilty to a charge of being unable to have proper control of his vehicle.
The incident came to light at Portstewart Road, Portrush, on August 12 last year.
The court heard the defendant was a business owner with 24 staff.
The defendant, of Hartley Hall Close in Greenisland near Carrickfergus, had the matter mentioned at Coleraine Magistrates Court on Monday where he was fined £150.
